SC Refuses To Interfere, NEET Age Cap to Stay
Many controversies arose right from the day CBSE did modify the age limit criterion for the National Eligibility-cum-Entrance Test of 2018(NEET). However, the final verdict from the Supreme Court of India put an end to the controversy. First, the SC refused to interfere in the controversy and granted the NEET age cap to stay. As per this order, the NEET aspirants from the general category older than 25 years will not be able to appear for the exam. For the reserved category, the candidates above 30 will not be able to appear in NEET this year.
The petition was challenging CBSE revised age limit restriction for appearing the NEET since there is no age restriction for appearing for other similar competitive entrance examinations like All India Institute of Medical Science (AIIMS ) and JIPMER (Jawaharlal Institute of Postgraduate Medical Education and Research). This is applicable for the admission to the undergraduate medical and dental courses in different private and government medical, educational institutions in India.
The petition was from a group of ten students hailing from a different state in India who challenged the CBSE's revised policy on age cap for the aspirants. They contend that other similar institutions like JIPMER and AIIMS have not imposed such restrictions. The counsel for the student's Advocates Amit Kumar argued that the decision was illegal and arbitrary. The prayer to the court was to allow the petitioners to take NEET (National Eligibility and Entrance Test). However, the SC rejected the plea for scrapping upper age limit.
This order is good for the fresh out of Class 12 as they will not have to compete with the NEET aspirants of higher age bracket. Those in the higher age bracket would have acquired better exposure in such competitive exams, both in theory and practice. At the same time, this is a major blow to scores of NEET candidates in the general as well l as reserved categories for the National Eligibility-cum-Entrance Test of 2018 (NEET)
The order came at the right time as the due date for applying for the UG NEET exam 2018 is about to close. The order having fart reaching consequences were announced by the Supreme Court bench of Justices SA Bobde and L Nageswara Rao.
NEET 2017 Verdicts
Incidentally last year the Supreme Court removed the age cap of 25 years and extended the last date for online application submittal of medical entrance exam NEET 2017.
The Supreme Court also was categorical in its verdict and restrained the high courts from interfering in the matters like choice, allocation of centres. Further SC said that if any contrary order has already been passed by any of the courts, then the CBSE shall be bound by order of apex court only.
The SC bench has also made it clear that the age limit prescribed by the CBC, the nodal agency for conducting NEET cannot be overruled by notice by instructions issued by the Medical Council of India (MCI). SC also directed regarding the additional centres for exams.
The court also restrained the high courts from interfering in the matters like choice and allocation of centres. The court added that if any contrary order has already been passed by any of the courts, then the CBSE shall be bound by order of apex court only.
NEET 2018 Age Limit Prescribed.
If only a student satisfies age limit criteria and other conditions such as attempts and educational eligibility criteria, can appear in NEET exam.
- Lower Age Limit 17 Years as on or before 31st December of admission year
- Upper Age Limit 2018 25 Years for General candidates (Expected)
- 30 Years for Other Category Candidates – as 5 years age relaxation is applicable (Expected)
Thus NEET aspirants who are having 17 years or more can only apply for NEET.
In a nutshell for the NEET 2017 exam, the Supreme Court has ruled that there will not be any upper age limit for the candidates appearing for that year. Now with the verdict, SC has put an end to the stipulations and rumours regarding NEET 2018 age limits.
